State government agencies and any other entities outside SA government seeking to share data under the Public Sector (Data Sharing) Act 2016 must complete a data sharing agreement that outlines how both parties will fulfil the trusted access principles.

The Public Sector (Data Sharing) Act 2016 enables South Australian public sector agencies to share data with each other and/or with other trusted entities under the conditions of individual data sharing agreements. Reviewing the Act is recommended to understand your obligations.

Agreements can be between two or more agencies or entities. An agency or entity can be a data provider, a data recipient, or both.

A completed (signed) data sharing agreement must be lodged with the Office for Data Analytics (ODA) to meet annual reporting requirements under the Public Sector (Data Sharing) Act 2016. ODA will issue a reference number for your records.

For new agreements between South Australian government agencies and any other entities outside SA government (e.g. NGOs, all other tiers of government, councils, industry, research/education sector etc.).

This form must be lodged with ODA to arrange a final signature from the Treasurer – or the Treasurer’s delegate.
